RAVEN’S NEST

1. Introduction

Welcome to Raven’s Nest, operated by TRANSILVANIA RAVEN SRL, a commercial company registered in Romania, with the Trade Register Registration Number J2021001132017 and Unique Registration Code RO29663664. These Terms and Conditions govern the contractual relationship between TRANSILVANIA RAVEN SRL (the “Provider”, “we”) and you (the “Client”, the “Guest”). By accessing and using our services, you confirm the full and unconditional acceptance of these terms. For details regarding the processing of personal data and the use of our website, please refer to the Privacy Policy and the Terms of Use available on the site.

2. Conclusion of the Contract

By making a reservation and/or using the services offered by Raven’s Nest, the Client confirms that they are at least the legal minimum age of 18, possess the full legal capacity necessary to conclude valid legal acts, and unconditionally accept these Terms and Conditions. This act constitutes a valid contract concluded between TRANSILVANIA RAVEN SRL (Provider) and the Client (Guest), governed by the provisions of these Terms and Conditions and by the applicable Romanian legislation. The Client undertakes to provide accurate, complete, and truthful information during the booking process and throughout their stay.

3. Services Offered

3.1. Accommodation

  • Check-in (Arrival):
    • Access to the property is permitted starting at 3:00 PM on the day of arrival.
    • Check-in is performed exclusively upon presentation of a valid identity document (identity card, passport, driver’s license), starting at 3:00 PM.

    • The refusal or inability to present a valid document may lead to the cancellation of the reservation and the denial of access, without the right to compensation.
    • Check-in after 10:00 PM is not possible under standard conditions; the room will become available the following day, starting at 1:30 PM.
    • For check-in between 10:00 PM and the deadline set by the reception (if applicable), an additional fee of 150 RON per person may be charged, subject to prior confirmation of staff availability.
    • Upon check-in, you will receive the room key and an access card for the gate.
    • For their safety, we recommend handing them over to the reception during your absence from Raven’s Nest.
    • The loss or damage of the key/card entails the Client’s obligation to bear the replacement costs, estimated at 100 RON/key, 100 RON/lock (if replacement is necessary), and 100 RON/card.
  • Check-out (Departure):
    • Rooms must be vacated no later than 11:00 AM on the day of departure.
    • Access and presence on the property after vacating the room are allowed until 3:00 PM on the day of departure.
  • Other facilities:
    • Raven’s Nest does not have dedicated facilities for wheelchair access.
    • The rooms are not equipped with laundry facilities, a television, or a refrigerator/minibar.

3.2. Restaurant and Bar

  • Meals:
    • Breakfast is included in the standard accommodation rate unless otherwise specified in the booked offer.
    • Lunch, dinner, and other snacks can be purchased separately at the Sable by Raven’s Nest restaurant.
    • Meals in the restaurant are served based on a prior reservation.
    • Guests are kindly requested to make reservations either online by accessing the Sable webpage or by contacting the resort staff.
    • Reservations for the current day can be made no later than 10:00 AM.
    • Given the limited capacity, we strongly recommend making reservations in advance to guarantee seat availability.
    • Sable’s terms and conditions, available here, apply to table reservations.
    • The schedule for serving meals and operating the bar is displayed at the location and/or on the website.
  • Bar:
    • Alcoholic beverages cannot be purchased by individuals under 18 years of age.
    • Bringing in and consuming outside beverages (alcoholic or non-alcoholic) within the Raven’s Nest premises (rooms, restaurant, courtyard, common areas, etc.) is strictly prohibited.
    • Failure to comply with this rule may result in the immediate termination of the service contract, eviction from the property, and the retention of the amounts paid as a contractual penalty.

3.3. Activities and Relaxation Areas (Optional Services)

  • The location of Raven’s Nest in a mountainous area means that guests must be aware of and prepared for the conditions and potential risks specific to this type of environment.
  • Relaxation areas include a sauna, hot tub, projection areas, and hammock areas.
  • Upon request and depending on conditions, a campfire can be organized.
  • Access to activities and relaxation areas may be restricted by the Provider and may involve additional costs, according to the displayed rates.
  • Furthermore, the Provider reserves the right to restrict access to certain areas of the property for reasons related to guest safety.
  • The organization of optional activities depends on availability, weather conditions, the physical preparedness of the participants, and other reasonable safety criteria.
  • Concluding the accommodation contract does not automatically guarantee access to these additional services.

4. Reservations, Modifications, and Cancellations

  • Reservation Confirmation: A reservation is considered firm and produces legal effects only after written confirmation (usually by e-mail) from Raven’s Nest and after full payment or the payment of the requested advance, according to the offer conditions.
  • Reservation Modification: Subsequent modifications to a confirmed reservation are possible only with the express consent of Raven’s Nest and subject to availability.
  • Unapproved modification requests do not generate the right to a refund of the amounts paid.
  • The Provider’s Right to Refuse/Cancel: We reserve the right to refuse any reservation request prior to its confirmation, at our discretion.
  • We also reserve the right to cancel a confirmed reservation for justified reasons (e.g., technical unavailability, force majeure), with the obligation to fully refund the amounts paid in advance by the Client for unrendered services.
  • In such a situation, our responsibility is strictly limited to the refund of the amounts paid, without any other compensation.
  • Client Cancellation Policy and Refunds:
    • Confirmed and paid reservations are generally non-refundable.
    • Failure to arrive on the arrival date (no-show) entails the total loss of the amounts paid in advance.
    • No refunds are granted for services included in the reservation but unused by the Client (e.g., early departure, non-participation in included meals, etc.).
    • In documented exceptional cases (e.g., impossibility of obtaining a visa, with a cancellation notified at least 20 days in advance), we may offer a value voucher, usable according to a specific policy.

5. Rates and Payment Methods

  • The rates for accommodation, meals, and additional services are those displayed on the website, at the reception, or communicated in the reservation offer.
  • Payment for services can be made:
    • Online, in advance, at the time of booking (for accommodation and packages).
    • At the reception, upon check-in or check-out, as applicable, in cash (RON) or by bank card (Visa, Mastercard).
    • When paying by card, the presentation of an identity document of the cardholder may be requested.
  • A fiscal receipt will be issued for all payments made at the reception. The fiscal invoice is issued upon request.
  • Additional services consumed during the stay are usually paid at check-out, unless otherwise agreed, but payment on the spot may also be requested.
  • The costs associated with payment transactions (e.g., bank commissions) are the responsibility of the Client.

 

6. Internal Rules and Prohibitions

For the comfort and safety of all guests, please observe the following rules:

  • Relaxation Areas: Access for minors under 14 years old to relaxation areas (sauna, hot tub) is prohibited.
  • The operation of the equipment (sauna, hot tub) is carried out exclusively by authorized personnel; any intervention by guests is prohibited.
  • Moving existing hammocks or installing your own hammocks is prohibited.
  • Violating these rules may result in penalties (100 EUR/violation) and the obligation to cover any potential damages.
  • Objects and Equipment: It is forbidden to remove objects provided in the rooms or other areas of Raven’s Nest.
  • The use of personal audio systems at a high volume (portable speakers, phones, etc.) that may disturb other guests is prohibited.
  • Photo/Video/Drones: Conducting professional photo/video sessions or using drones requires the prior written consent of Raven’s Nest management.
  • Unauthorized use of drones is strictly prohibited and may attract legal sanctions, contract termination, and penalties (500 EUR/violation).
  • Exceptions cumulatively require a valid flight authorization in Romania and our express consent.
  • Smoking: Smoking is allowed only in specially designated and marked areas.
  • Smoking inside buildings or at a distance of less than 10 meters from them is prohibited and is sanctioned with a sanitization/penalty fee (50 EUR).
  • Throwing cigarette butts or other waste outside trash cans is similarly sanctioned (e.g., 50 EUR) and may also attract contraventional sanctions according to the law.
  • Food and Beverages: The consumption of food and drinks purchased outside Raven’s Nest is prohibited in common areas and, potentially, in rooms (please check the specific displayed regulations).
  • A violation may attract a contractual penalty (e.g., the equivalent of the cost of meals for the entire stay, calculated at 37 EUR/day/person).
  • Pets: Access with pets is strictly prohibited within the Raven’s Nest premises.
  • Behavior: The excessive consumption of alcohol, consumption of illegal substances, and aggressive, inappropriate, or disturbing behavior towards other guests or staff are prohibited.
  • Consequences of Non-Compliance with the Rules: Serious or repeated violation of these Terms and Conditions or the rules of conduct displayed at the location may lead to the immediate termination of the service contract, a request to immediately leave Raven’s Nest, and the retention of the amounts paid, without the right to compensation.

7. Liability

  • Provider’s Responsibility: We assume liability for damages caused directly to the Client due to our exclusive fault or that of our employees, in accordance with applicable legal provisions and as proven by the Client.
  • Our liability will not exceed the value of the services contracted by the Guest, except for cases expressly provided by law.
  • We are not liable for indirect, potential, or future damages suffered by guests.
  • Limitations of Liability:
    • The Client fully assumes the risks associated with moving around and using facilities in a potentially rugged mountainous environment.
    • The Provider informs Guests that water from local natural sources (springs) is not constantly tested to guarantee its potability.
    • Consequently, Raven’s Nest cannot be held liable for its quality and recommends the consumption of bottled water.
    • Being located in a mountainous area, the presence of wildlife (including insects, snakes) and local flora (some species potentially being poisonous) is a natural aspect of the environment.
    • Raven’s Nest cannot control these elements and, therefore, cannot be held liable for any potential interactions.
    • Guests are kindly requested to exercise appropriate caution and vigilance during their stay.
    • We do not assume liability for the loss, theft, or damage of guests’ personal belongings left in rooms or common areas.
    • We do not offer secure storage services for valuables.
    • We are not liable for damages or injuries occurring as a result of the Client’s non-compliance with the warnings, displayed recommendations, or instructions of the Raven’s Nest staff.
  • Client’s Responsibility:
    • The Client is directly liable for any material or moral damage caused to the property, facilities, staff, other guests, or third parties, through their own actions, those of the persons accompanying them (including minors), or persons under their supervision, whether through negligence or intent.
    • The Client undertakes to fully repair the damage caused, including moral or image damage.
    • The Client is obliged to constantly supervise the minors accompanying them.

 

8. Force Majeure and Fortuitous Events

  • Neither party shall be liable for the failure to perform on time and/or the improper performance, in whole or in part, of any obligation incumbent upon them under this contract, if the failure to perform or improper performance of the respective obligation was caused by a force majeure event or fortuitous event, as defined by law (e.g., war, natural disasters, fires, floods, strikes, legal restrictions, pandemics, extreme weather conditions affecting infrastructure, unforeseen utility interruptions).
  • The party invoking force majeure has the obligation to notify the other party within a reasonable time from its occurrence and to take all possible measures to limit its consequences.

 

9. Consumer Protection and Dispute Resolution

  • We are committed to respecting consumer rights in accordance with applicable Romanian and European legislation (e.g., GEO 34/2014 on consumer rights in contracts concluded with professionals, the EU Directive on consumer rights, the EU Directive on unfair commercial practices).
  • We ensure that advertising and pre-contractual information are accurate and transparent.
  • Complaints: Any dissatisfaction or complaint regarding our services can be addressed to the management team at the location or in writing, at the contact details mentioned below.
  • We will make all reasonable efforts to amicably resolve any reported issue.
  • Alternative Dispute Resolution/Litigation: If a dispute cannot be resolved amicably, the Client (acting as a consumer) has the right to use the alternative dispute resolution (ADR) mechanisms provided by the National Authority for Consumer Protection (ANPC).
  • For cross-border online disputes, the European ODR (Online Dispute Resolution) platform can be used.

10. Modifications to the Terms and Conditions

  • We reserve the right to unilaterally modify these Terms and Conditions at any time.
  • The updated version will be published on our website and/or displayed at the reception.
  • The continued use of our services after the effective date of the modifications constitutes tacit acceptance of the new terms.
  • For already confirmed reservations, the terms in effect on the date of confirmation apply, unless modifications are mandated by law.

SABLE CONTEMPORARY CUISINE

General Conditions

Reservations at the Sable restaurant can be made exclusively through the official website https://ravensnest.eu/. By making a reservation, the client unconditionally accepts these regulations.

Reservation Fee

To confirm the reservation, the client is obliged to pay an advance reservation fee of 250 RON/person, according to the payment instructions provided in the confirmation email. The payment of this fee is an essential condition for validating and confirming the reservation. The paid reservation fee will be fully deducted from the final bill corresponding to the consumption within the restaurant. If the value of the consumption is less than the paid fee, the remaining amount will not be refunded.

Cancellation or Modification of the Reservation

If the client requests the cancellation of the reservation, the reservation fee will be fully refunded only if the cancellation is made at least 14 calendar days prior to the confirmed date and time of the reservation. Confirmed reservations cannot be modified except with Sable’s consent. For any modification requests, you may contact us via email at contact@ravensnest.eu. A reduction in the number of guests does not result in a partial refund of the already paid reservation fee. Any other changes can only be made subject to seat availability, following an express prior confirmation from Sable.

Access to the Premises

Access to the Raven’s Nest resort premises will be permitted no earlier than 30 minutes before the scheduled reservation time. Clients with a lunch reservation are required to leave the resort by 6:00 PM, and those with a dinner reservation by 12:00 AM (midnight). Parking is free for Sable clients, subject to available spaces. We assume no responsibility for how the client travels to the location and recommend using appropriate means of transportation, considering the weather conditions and the fact that the restaurant is located in a mountainous area. Access with pets, as well as with outside food or drinks, is prohibited.

Special Dietary Requirements

We kindly ask clients to inform us in advance of any special dietary requirements. While we make every effort to accommodate these needs, we cannot guarantee that we will be able to fulfill all the requests received.
